They say everything is bigger in Texas, and apparently, that includes the age verification lawsuits.

Hammy Media, the parent company of xHamster, has finalized a settlement with the state of Texas over allegations that the adult platform failed to comply with Texas’s age verification law. The agreement requires the company to pay a $120,000 civil penalty, according to the Agreed Final Order filed in Travis County District Court on Nov. 7.

The lawsuit was originally brought by Texas Attorney General Ken Paxton in March 2024. State officials alleged that xHamster did not employ a legally sufficient method to confirm users’ ages, arguing that minors could bypass the site’s pop-up age gate by clicking outside the verification prompt. The state claimed the platform’s approach could not be considered a reasonable or effective safeguard.

Texas’ legal action was part of a broader push to enforce Chapter 129B of the Texas Civil Practice and Remedies Code, which took effect on September 1, 2023. The law requires adult sites to use government ID checks or similarly robust verification methods before granting access. The state initially sought penalties of up to $1.67 million, along with additional daily fines.

Litigation paused while the U.S. Supreme Court considered the constitutionality of Texas’s law in the Free Speech Coalition’s challenge, FSC v. Paxton. In March 2025, the Court upheld the statute, allowing Texas to resume pending cases and pursue new actions under the law.

According to the final order, xHamster restricted access to its site on March 21, 2024, just two days after the lawsuit was filed, and later implemented the verification measures required under state law. The settlement specifies that the company admits no wrongdoing. The injunction outlined in the order requires xHamster to continue using a compliant age verification process for as long as Section 129B.003 remains active. If that section of the law is repealed, invalidated, or otherwise becomes unenforceable, the injunction will terminate automatically.

The agreement also notes that payment must be received by the Office of the Attorney General within 30 days of the court’s signature. Each party will bear its own legal fees, and the order disposes of all claims related to the state’s initial petition.

Texas has pursued similar cases against other major adult platforms. Chaturbate’s parent company, Multi Media, settled with the state in April 2024. Litigation remains ongoing against Aylo, the parent company of Pornhub.

The xHamster settlement marks one of the most significant enforcement actions since age verification laws began taking hold nationwide. It also reflects a shift in how states are approaching compliance, placing increasing pressure on adult platforms to adopt more stringent user verification systems.
