U.S. District Court Issues Permanent Injunction Against Content Pirates

It’s not a good day for content thieves. A U.S. district court in California has issued a permanent injunction against three individuals involved in the operation of Goodporn and its mirror sites, which hosted full, streamable versions of Aylo’s content without authorization. The ruling marks a decisive step in the fight against digital piracy.

On Monday, Judge Mark C. Scarsi expanded his previous judgment from February, where he awarded Aylo $2,157,000 in damages. The defendants, Amrit Kumar, Lizette Lundberg, and Emilie Brunn, were found to have no rights to the content owned by Aylo (the parent company of Brazzers and Pornhub).

The latest ruling includes a comprehensive order for third-party providers to block U.S. access to the infringing sites at the domain level.

This injunction is unique in its scope, extending beyond the defendants to third-party providers such as Cloudflare, Google, and domain registrars. Internet Service Providers (ISPs), search engines, and other intermediaries are mandated to take actions to block access to the domains themselves, not just the content.

Judge Scarsi’s order states: “Defendants, their agents, servants, officers, directors, employees, attorneys, privies, representatives, successors and assigns and parent and subsidiary corporations or other related entities, and any or all persons or entities acting in concert or participation with any of them, or under their direction or control, including any internet search engines, web hosting and Internet service providers, domain name registrars, domain name registries and other service or software providers are ordered, within five business days from the service of the Judgment to block or use reasonable efforts to attempt to block access by United States users of the Goodporn websites by blocking or attempting to block access to all domains, subdomains, URLs, and/or IP addresses that have as its sole or predominant purpose to enable to facilitate access to the Goodporn websites.”

Aylo expressed satisfaction with the court’s decision. “We take any infringement of our content and brands seriously and remain committed to protecting our intellectual property rights,” an Aylo representative stated. “We believe this amended judgment will contribute to deterring piracy and will help ensure consumers find our content through legitimate channels.”

Jason Tucker of Battleship Stance, who consulted on the case for Aylo, highlighted the peculiar nature of the case.

“The Defendant flagrantly exhibits full-length movies without proper licenses and ignores takedown notices,” Tucker said. “In response to legal action, Amrit Kumar made the audacious claim of owning the entire past and future library of movies and images belonging to Aylo, citing a ridiculous ‘agreement’ as justification.”

Judge Scarsi previously dismissed Kumar’s alleged “bilateral agreement” as lacking any indicia of reliability or authenticity. This document had been introduced by Kumar in his legal filings as purported permission to stream copyrighted content from Brazzers and other Aylo-owned studios.

The court’s decision mandates that mirror sites associated with Goodporn will begin going offline starting Wednesday. This action is part of the broader enforcement of the permanent injunction, aimed at ensuring that the infringing sites are effectively blocked from U.S. users.
