There’s been a lot of talk about the infamous Kim Kardashian sex tape and how it got “leaked.” While that may make for great headlines, the truth of the matter is, it’s impossible to “leak” a sex tape of any kind in the United States.
Yesterday it was all over the news that she was worried a new sex tape that she made while with Ray J would get “leaked.” But those in the adult industry know that’s total and complete bullshit.
The original 2007 tape, filmed when Kardashian and Ray J were dating at the time, gave rise to what would become her family’s E! reality show, “Keeping Up With the Kardashians.”
The problem is that the marketing behind the sex tape was that it got leaked, and she was the victim. That is nothing short of #fakenews.
It’s so easy to put out this false narrative and blame the sex industry, but the truth is, Kim Kardashian had to give written permission to release her tape. Read that – RELEASE, not leaked but released.
SHE released her sex tape and was paid for doing so.
According to the man who originally wanted to broker the deal (Kevin Blatt), she has made $20 million from the sale of the movie alone. But keep in mind, that number grows every month as, from what I understand, she will get a royalty on views and DVD sales for the life of the movie, a deal normal porn stars don’t get. That means that even 20 years from now, she’ll still be making bank every time someone watches that movie, as will Ray J.
SHE signed all the legally required documents to release the sex tape as well as verify her age with her government-issued ID.
This is no different than how it works for your average porn star who films a movie for a company like Brazzers or BangBros.

- You sign a model release.
- You sign some 2257 (age verification) documents.
- You give a copy of your government-issued ID.
- The movie gets edited.
- The movie gets released.
Every adult movie out there right now follows this process. It doesn’t matter if the star is a celebrity or the girl next door. The law requires these steps. It’s not optional.
It is a criminal act to release nude photos or videos of a person without their written permission. This is something the Kardashian family knows all too well. Kim’s own brother Rob released nude images of his then-fiance Blac Chyna and is now facing charges of revenge porn, which in many states is a felony. Although not in California, where Rob Kardashian lives. Still, it is a crime.
Revenge Porn Penalties (PC 647(j)(4)) – PC 647(j)(4) classifies revenge porn as a matter of disorderly conduct, which is a misdemeanor in California. If you are convicted of this crime, a first offense could land you in county jail for up to six months and you could also be fined up to $1,000 fine under PC 647.
In addition to the criminal aspect of it, there is the civil aspect, which holds much bigger financial penalties. In other words, you can sue someone for revenge porn. (aka leaked sex tape, leaked nude images)
If your intimate image has been published (on social media, to a pornography site, or even shared via text message) without your consent, you have the right to sue the responsible parties for compensation and to force websites and other media platforms to remove your image.
In a conversation with The Sun, Kevin Blatt (the man who brokered the sex tape deal for Kim Kardashian) spoke at length about Kim Kardashian and Ray J’s sex tape. In his chat with the publication, he claimed he was offered that he has the chance to buy the video from Ray in 2006. Describing the singer-actor as someone ‘eager’ to strike a deal, Blatt revealed he was informed of the tape’s existence by a childhood friend who was working at Adult Video News during that period.
Further talking about Kim Kardashian and Ray J’s sex tape, the broker – who made a name for himself in the trade by releasing Paris Hilton’s sex tape with Rick Salomon – One Night In Paris, said that Ray allegedly told him that Kim “wanted to release the sex tape for free the weekend before, but he had to talk her out of it.”
Blatt stated, “Ray J told me, ‘She wants to be bigger than Paris.’” He added, “I told him, ‘Ray J, you cannot let her release it for free – don’t let her do that. There’s too much money out there.’ Blatt continued, “’ I can give you the best deal ever and I’m gonna bring in somebody who’s gonna pay you a million dollars right now.’”
The notorious sex tape broker added that he was ready to make a deal and pay Ray J handsomely for his and Kim Kardashian’s sex tape, but the singer went behind his back and gave it to another – Vivid Entertainment.
Following the release of Kim Kardashian, Superstar, the now-mother of four, Kim filed a lawsuit against Vivid, accusing the company of releasing the tape without her permission. However, she quickly dropped the case after enlisting the help of Girls Gone Wild creator Joe Francis, who helped acquire her $5 million for the tape’s distribution instead.
As per Kevin Blatt’s conversation further, he was disappointed to have missed out on the opportunity to have brought the sex tape. He further estimated that Kim Kardashian alone had likely made over $20 million from the tape. A 2017 report by TMZ – alleged that Ray J was still reportedly earning $90,000 in royalties every three months.
In the same interaction, Kevin Blatt also shockingly claimed that there were quite a few X-rated scenes in the version of the sex tape he watched. Saying that a number of scenes were actually deleted from the final Kim Kardashian-Ray J sex tape – but declining to mention which they were, the broker said,
“What I can tell you is that on the initial tape of Kim Kardashian there was a lot of stuff that was excluded.”
Kevin Blatt added, “I don’t think the family would’ve been the entity that they are today if a lot of that other stuff had made it onto the final tape.”
Kim Kardashian isn’t the only celebrity to claim to have had a sex tape leak.
