Judge Tosses Copyright Suit Against Lovelace

The 2013 film Lovelace is a biography of Linda Lovelace, one of the first porn stars, and it puts a Hollywood spin regarding her experiences filming the classic flick, Deep Throat. When Lovelace came out the original producers of Deep Throat sued the Wieinstein Co. claiming copyright violation. On Monday, a Manhattan judge tossed out the lawsuit.  

Among the many points U.S. District Judge Thomas Griesa made in his decision to toss the case, his main reasoning was the differences between the films. After reviewing both films, he noted very distinct differences between them. The gist of it is one is a pornographic film filled with sex and the other is a bio-pic about the tragic life of Linda Lovelace. The scenes in Lovelace that imitate scenes from Deep Throat are from the perspective of Lovelace; and therefore they aren’t copying the original film. A blow to Arrow Productions, who attempted to prevent the film from being released back in 2013, their attorney Evan Mandel said they are was reviewing the decision and considering an appeal.

Deep Throat is a groundbreaking film, an argument could be made that it is the best porn ever made (Debbie Does Dallas and Alice in Wonderland: An X-Rated Musical Fantasy are also top contenders), but no one will confuse it with Lovelace.
