Nikki Files a Motion to Strike
Porn superstar Nikki Benz has filed an anti-SLAPP motion to strike against director Tony T.'s lawsuit, AVN has reported. T. filed a lawsuit against her and against Brazzers after Benz made statements on Twitter back in December alleging that she had been physically and sexually assaulted on a Brazzers set by T. Performer Ramon Nomar was in the scene in question and was originally suing Benz and Brazzers alongside T. but has since dropped out of the suit.
SLAPP stands for “strategic lawsuit against public participation” and a lawsuit that uses SLAPP is one that is intended to censor, intimidate and/or silence people by burdening them with the cost of having to have a legal defense in an effort to get them to abandon their opposition to something or someone's actions, like what Benz alleges happened on that porn set. The suit is being tried in California and California has anti-SLAPP suit laws.
In her Motion to Strike, Benz, through her attorney Lisa L. Maki, says that, "Tony T. presents nothing more than generalized allegations of defamation," and that he "cannot prove [Benz] acted with actual malice."
A case management meeting is set up for the parties in the case for May 16th. Brazzars has made no statement about Benz's anti-SLAPP motion.
